What is the "Lemon Law" and how is it enforced in California?
There are both federal and state laws which apply to defective
vehicles specifically, and other consumer products generally.
1.
The Magnuson-Moss Warranty
Act is the federal law that governs consumer product warranties.
Passed by Congress in 1975, the Act requires manufacturers and
sellers of consumer products to
provide consumers with detailed information about warranty coverage.
In addition, it affects both the rights of consumers and the
obligations of warrantors under written warranties.
2. The Uniform Commercial Code (the "UCC") has been adopted
in all 50 states and includes provisions pertaining to contracts
dealing with the sale of products. In addition to consumer rights
under state lemon law statutes, and the federal Magnuson Moss
Warranty Act, the Uniform Commercial Code is a set of laws which may
be used in limited circumstances in dealing with the
manufacturer or dealer.
3. The California Lemon Laws are embodied in California Civil
Code sections CC 1793.22-1793.25 (the Tanner Consumer Protection
Act, or "California lemon laws"), and are a subsection of the
California Song-Beverly Consumer Warranty Act.
